We, at Numeric Vision Technologies FZCO, extend our sincerest gratitude for choosing Oryum. This document, henceforth referred to as the "Terms of Service" or "Agreement," governs your engagement with Oryum and outlines the legal obligations and rights concerning your use of Oryum and all associated services. This Agreement is binding for all users of Oryum and its services.

1. Legal Agreement

Ownership and Agreement Acceptance

Oryum is a proprietary gaming platform owned by Numeric Vision Technologies FZCO. This document establishes a legally binding agreement between you, herein referred to as the "Member," and Numeric Vision Technologies FZCO. By accessing or using Oryum and any related services, you unequivocally acknowledge and agree to these Terms of Service (ToS). Your engagement with Oryum is governed at all times by this Agreement and our Privacy Policy. This encompasses all user-generated content on Oryum, including but not limited to user profiles and in-game conduct. You may also be subject to additional terms when you use, purchase, or access other Oryum services, services from affiliates, or third-party content.

Updates and Revisions

Given that Oryum is a dynamic and evolving platform, Numeric Vision Technologies FZCO urges all Members to periodically review these ToS. We reserve the exclusive right to modify, amend, or update these ToS and our services at our discretion, which may be enacted with or without prior notice. Such modifications become effective upon their publication on Oryum. Your continued use of Oryum following the announcement and availability of amended ToS signifies your consent to be bound by the revised terms. Should you find the revised ToS unacceptable, you must cease using Oryum immediately and cancel any subscriptions or services registered under your User ID.

2. User Identity and Account Creation

Establishing Your Identity

By setting up a user identity, hereafter referred to as "User ID" and "Account," during the Oryum registration process, you confirm your understanding of and agreement with the Terms of Service (ToS). You are required to furnish accurate and truthful information throughout the registration phase and to authentically represent yourself. Should you be under the age of majority, the registration must be supervised or completed by your parent(s) or legal guardian(s). They assume full responsibility for adherence to this Agreement and bear liability for all activities conducted through the Account, whether these are undertaken by you or by others, with or without authorization.

Choosing Your Credentials

As part of account creation, you will be asked to select a unique login name ("User ID" or "account name") and a secure password. It is crucial that these credentials are kept confidential to ensure your account's security.

Responsibility for User ID

You hold sole responsibility for the actions taken under your User ID. Numeric Vision Technologies FZCO maintains a zero-tolerance policy towards User IDs that are deemed offensive, obscene, or otherwise not in compliance with these ToS. Determination of such violations is at the exclusive discretion of Oryum support staff. In the event of a violation, we reserve the right to suspend or terminate access to Oryum or its services for the offending User ID, potentially without prior notice.

3. Account Security

User Responsibilities

As the holder of an Oryum account, you bear the full responsibility for safeguarding the confidentiality of your account credentials and the security of your computer system from unauthorized access. You are solely accountable for all activities conducted under your account, irrespective of whether you have authorized such actions. It is imperatively forbidden to disclose your password or account details to others, regardless of the circumstance, nor is it permissible to permit others to use your account. Actions such as sharing, exchanging, or transferring accounts, including the sale or trade of login details, are strictly prohibited. Violations of these security measures may lead to disciplinary actions, which include, up to and including, the termination of service at the sole discretion of our support team. The Oryum team will never request your password, and under no circumstances should it be disclosed to anyone, including during communications with our support staff.

Liability and Indemnification

By creating a User ID, you agree to indemnify Numeric Vision Technologies FZCO and its affiliates against any misuse of your account, including illegal or unauthorized use by anyone to whom you may have disclosed your password. Numeric Vision Technologies FZCO assumes no liability for the misuse of your account, whether by you or by a third party. We strongly advocate for responsible behavior within any online community and urge all users to practice safe internet habits.

Reporting Security Breaches

Should you suspect or become aware of a potential breach in the security of your account details, it is your obligation to report this to the Oryum support team immediately via email or through the Oryum Support Helpdesk. We are committed to collaborating with appropriate authorities to investigate and prosecute online criminal activity, including the pursuit of those who file fraudulent or false reports.

4. Rules of Conduct

General Adherence to ToS

Membership in the Oryum community mandates unwavering compliance with these Terms of Service (ToS), applicable legal statutes, and the foundational principles of respect, courtesy, and common sense in all interactions and engagements. Behaviors deemed unlawful or inappropriate in offline contexts are equally unacceptable and in violation of these ToS. Numeric Vision Technologies FZCO unequivocally prohibits illegal activities and will collaborate with legal authorities to address such matters.

Enforcement and Penalties

Numeric Vision Technologies FZCO reserves the right to undertake any necessary measures, including the imposition of penalties, to prevent and address violations of these ToS or any conduct deemed illegal or inappropriate, at its sole discretion and without the need for prior notification. Decisions regarding the occurrence of a violation and the identification of the violator rest exclusively with Oryum management, guided by what is considered in the best interest of the community. By participating in Oryum, you consent to be bound by these determinations and any consequent disciplinary actions.

Community Diversity and RoC

The Oryum community is comprised of members from varied backgrounds and experiences, each with their own sensitivities and expectations. The established Rules of Conduct (RoC) aim to foster a welcoming, enjoyable, and secure environment for the majority of our members.

Information Collection Rights

Numeric Vision Technologies FZCO is entitled to collect, without prior notice, specific information about your device and software, such as operating system, hardware identifiers, IP address, and internet browser for identification purposes. Additionally, for demographic analysis and community safeguarding against unfair practices, such as the use of unauthorized hacks or cheats, we may collect non-personal and technical information from your device. This data will be solely used for enforcing compliance with this Agreement and other company policies.

Compliance with Basic Rules

As a member of the Oryum service, you are expected to adhere to the basic rules of conduct that govern interactions and activities within our platform and under the purview of Numeric Vision Technologies FZCO. Non-compliance may result in immediate termination of your account(s) and revocation of your rights to use the Oryum service, without entitlement to refunds. Upon termination, you will also forfeit any remaining or unused in-game assets, virtual currency, and any subscriptions.

a) Compliance with Oryum's Ethos and Legal Standards: Every piece of user-generated content, whether it be identities used within the game (User IDs, game IDs), group affiliations (guild and clan names, emblems), or interactions (chat content, forum posts), must adhere strictly to the Terms of Service and Rules of Conduct set forth by Oryum. Additionally, such content must not violate any applicable laws. This ensures a respectful and legally compliant community environment.

b) Intellectual Property Respect: Users are expressly prohibited from modifying, adapting, translating, or creating derivative works from any component of the Oryum site, its associated services, games, or any software code belonging to Numeric Vision Technologies FZCO without obtaining direct written permission from the company. This maintains the integrity and originality of the Oryum ecosystem.

c) Prohibition on Impersonation: Impersonating any Oryum employee, business partner, or their respective staff members, whether they are currently associated with the company or have been in the past, is strictly forbidden. This includes, but is not limited to, individuals in support roles, ensuring a trustful relationship between users and the platform.

d) Language and Behavior Standards: Oryum upholds a strict policy against the use of any language or behavior that is unlawful, threatening, abusive, obscene, harmful, defamatory, vulgar, harassing, racially or ethnically offensive. This guideline is enforced to foster a respectful and welcoming community for all players, irrespective of the language used.

e) Harassment and Distress: Any actions that threaten, harass, cause distress, or generate unwanted attention towards other players are prohibited. Decisions on such matters are made at the sole discretion of Oryum support personnel, emphasizing the importance of a positive and respectful gaming environment.

f) Community Integrity: Membership in, or support of, any group or association that promotes discriminatory or hateful ideologies based on race, gender, religion, or ethnicity is strictly banned. Similarly, groups that consistently violate the Terms of Service or engage in harmful activities undermine the community's integrity and are not allowed.

g) Sexual Content Restrictions: The use of sexually explicit language, especially when graphic, inappropriate, or depicting sexual acts, is not permitted. This rule also covers language that is violent or threatening in nature towards individuals or groups, safeguarding the community against offensive content.

h) Marketing and Solicitation Limits: Engaging in marketing, promotion, advertising, or solicitation activities within Oryum, including the distribution or advertisement of virtual or real-world assets, is strictly prohibited. This policy ensures the platform remains dedicated to gaming experiences, free from external commercial influences.

i) Encouragement of Rule Violation: Directly or indirectly prompting, encouraging, or facilitating other members to breach the Terms of Service, Rules of Conduct, or applicable laws is forbidden. This ensures that all members contribute positively to the community's welfare.

j) Lawful Conduct Requirement: All interactions and activities on Oryum must comply with local, state, national, and international laws and regulations, reinforcing the platform's commitment to legal compliance.

k) Illegal Activity Prohibition: The Oryum services must not be used for any unlawful purposes, including the trade or distribution of pirated software or contraband. This guideline protects the integrity of the platform and its users.

l) Restricted Content Sharing: Posting or providing links to websites that contain illegal, sexual material, content that could harm another user's network or computer, or violate the Oryum Terms of Service is not allowed. This maintains a safe and respectful online environment.

m) Service Use Limitations: The Oryum service is to be used solely for the purposes intended and permitted within the service, game, website, or associated environments. This ensures that all platform resources are dedicated to enhancing the user experience.

n) Account Supervision: Leaving an account logged in and unattended, either through software automation or physical means, is prohibited. Users must be present and responsive, ensuring active and conscious participation within the Oryum community.

o) Exploit and Bug Abuse: Exploiting any bugs, features, or design elements within the Oryum products or services for unfair advantage is strictly forbidden. Sharing information about such exploits, whether intentionally or not, compromises the integrity of the game and is therefore banned.

p) Network Integrity and Fair Play: The use of VPNs, proxies, or any technology to disguise or alter one's identity or location to gain unfair advantage or circumvent system restrictions is not allowed. This ensures fairness and integrity in all interactions within the Oryum services.

q) Adherence to Official Instructions: When using Oryum services, you are required to comply with the directions given by authorized personnel. Non-compliance may lead to disciplinary actions against your account, which can include termination. This ensures that the platform operates smoothly and safely for all users.

r) Privacy and Confidentiality: Disclosing any real-world personal information of any player, including yourself, within the Oryum services is strictly prohibited. This includes, but is not limited to, sharing your account password or personal account details with others. You also agree not to hold Oryum or its subsidiaries liable for any harm resulting from such disclosures. This policy is in place to protect the privacy and security of our community members.

s) Accuracy of Information Provided: Providing false or misleading information to Oryum, especially concerning contact, account, or billing details, is forbidden. You are responsible for ensuring that all such information remains up-to-date. This accuracy is crucial for maintaining effective communication and service provision.

t) Unauthorized Software and Emulation: The use, creation, or distribution of any server emulation or services that allow Oryum products to be played outside the official platforms, or any related utilities, applications, or software not expressly authorized by Numeric Vision Technologies FZCO, is prohibited. This guideline helps protect the integrity and security of the Oryum gaming experience.

u) Security and Integrity: Attempts to interfere with, hack, or decrypt transmissions to or from Oryum servers or its service providers are strictly banned. These actions threaten the security and stability of our services and will not be tolerated.

v) Intellectual Property Rights: Violating the intellectual property rights of others, including uploading, transmitting, or sharing copyrighted material without proper authorization, is prohibited. This respect for intellectual property ensures a fair and lawful community environment.

w) Prohibited Transactions: Accepting items within the game that have been altered or manipulated outside the intended game mechanics is not allowed. Oryum reserves the right to remove any such items from your possession without compensation, emphasizing the importance of fairness and integrity within the game.

x) Ensuring Enjoyable Experience for All: Engaging in behavior that negatively impacts the ability of other users to enjoy Oryum games or services, or that increases the difficulty or cost for Oryum to maintain its services, is prohibited. This policy is in place to guarantee a positive and accessible gaming environment for every user.

y) System Abuse: Submitting false information, misusing support systems, or abusing help, email, or petition channels is forbidden. This ensures that support resources are efficiently and effectively utilized to assist genuine cases.

z) Authorized Platforms Only: Playing any Oryum product on services not authorized, approved, or overseen by Numeric Vision Technologies FZCO or relevant licensors is not allowed. This ensures that gameplay remains secure, fair, and within the designed ecosystem.

Acceptance and Acknowledgment of Terms

By engaging with the Oryum service, you affirmatively acknowledge and consent to abide by these terms in their entirety. This agreement extends to any individual who gains access to your account, whether such access is granted by you, occurs with your consent, or results from having access to your account or its information, in part or in full. You accept full responsibility and liability for all actions taken through your account, understanding that consequences may include, but are not limited to, warnings, account suspensions, or terminations resulting from any such violations.

Responsibility for Account Access

You recognize that you are accountable for safeguarding access to your Oryum account. This includes ensuring that any individual who accesses your account does so in compliance with these terms. Your responsibility encompasses any repercussions that may arise from misuse or violation of the terms by anyone accessing your account, underlining the importance of maintaining strict control over account access.

Adjustments for Balance and Fair Play

Numeric Vision Technologies FZCO reserves the right to make alterations, resets, or other changes to ongoing products or services as deemed necessary for maintaining or restoring balance. Such modifications may impact in-game assets, characters, progression, and overall service experience. These adjustments are essential for ensuring a fair and competitive environment for all users and may be implemented at Numeric Vision Technologies FZCO's discretion to enhance the quality and enjoyment of the service.

Ongoing Revisions to the Terms

The terms and conditions governing the use of Oryum services are subject to change. You agree to periodically review these terms on the Oryum website to stay informed of any updates or modifications. It is your responsibility to thoroughly read and comprehend these terms, ensuring your continued compliance with the evolving framework of the service.

Community Vigilance and Reporting

As a member of the Oryum community, you play a vital role in maintaining a respectful and safe environment. Should you encounter behavior or content that contravenes these Terms of Service, you are obligated to report such instances to the administration. While we strive to oversee community interactions, we rely on community members to report issues, as we cannot prescreen all content and communications. We retain the sole discretion to remove, edit, or modify any content that we find inappropriate or objectionable for the Oryum service at any time, without prior notice.

Discretionary Enforcement

Numeric Vision Technologies FZCO holds the exclusive right to enforce these terms as deemed appropriate. This includes the authority to modify, delete, or otherwise manage user-submitted content that violates the guidelines of the Oryum community or is found objectionable for any reason. Our actions are guided by a commitment to preserving the integrity and positive experience of the Oryum service for all users, with decisions made in our absolute discretion.

5. Disciplinary Actions and User ID Termination Procedures

Authority on Disciplinary Measures

Oryum maintains the authority to administer warnings, temporary suspensions, and permanent terminations of user accounts in response to breaches of the Terms of Service. The decision-making process regarding the imposition of disciplinary measures is vested solely with Oryum, reflecting a comprehensive evaluation of each case. Factors such as the gravity of the violation, its frequency, and impact on the community are considered, though these are not exhaustive criteria. It is important to understand that user accounts may be subjected to restrictions or bans, both temporary and permanent, without prior notification, as deemed necessary by Oryum.

Discretionary Powers

It is crucial for users to recognize that Oryum exercises unfettered discretion in determining the nature and extent of penalties and disciplinary actions. This authority extends to instances where there may be remaining credits or benefits associated with the user’s account. By agreeing to these terms, you acknowledge and accept that Oryum's decisions regarding disciplinary matters are final and may be executed without warning, based on the platform's internal assessments.

Appeal Process

Should you believe that any disciplinary action taken against your User ID is unjust, Oryum provides a formal channel for submitting appeals. Appeals can be lodged through a dedicated request/ticket system available in the Oryum support section or by sending a detailed email to [email protected]. All appeals are subject to a thorough review process by the support team. Please note that Oryum commits to considering only those claims deemed valid by its review team. The review process is designed to ensure fairness and accountability, and while every appeal is examined carefully, action will be taken solely at Oryum's discretion, based on its findings and the merits of the case.

6. Additional Account Termination Procedures

Initiating Voluntary Termination

Users wishing to terminate their account with Oryum may begin the process by submitting a termination request through a support ticket within the designated Support section of the platform. This initiates a formal review and processing sequence aimed at securely and efficiently handling the termination request.

Deactivation Period Following Termination Request

Upon receiving a termination request, Oryum implements a precautionary deactivation of the user’s account for a 14-day period. This temporary deactivation serves multiple purposes, primarily to:
Prevent any potential misuse, fraudulent, or deceptive activities that might be attempted using the account. Allow the user a grace period to reconsider the termination decision or to resolve any outstanding issues that may have prompted the request. This deactivation phase is a standard part of our termination procedure, reflecting Oryum’s commitment to user security and account integrity.

Automatic Deactivation for Inactivity

Oryum's policy mandates the deactivation of any User ID that has not been utilized within three months from the date of creation, or during any continuous three-month period thereafter ("Six-Month Term"). This policy is in place to streamline platform operations and manage resources efficiently.

Three-Month Inactivity Clause: Should your User ID remain unused for the initial three months post-creation or for any subsequent three-month period, it will be subject to automatic deactivation as part of our routine account management process.

Administrator Discretion on Account Deletion: Following the Six-Month Term of inactivity, the Oryum administration reserves the right, at its sole discretion, to permanently remove and delete the account. This action is considered a final measure, primarily aimed at optimizing platform performance and user experience by eliminating dormant accounts that no longer contribute to the community activity.

Reactivation Considerations

Users interested in reactivating a deactivated account are encouraged to contact Oryum support directly. The feasibility of reactivation will be evaluated on a case-by-case basis, taking into account the specific circumstances of the account's deactivation or deletion.

7. Content Ownership and User Rights

Acknowledgment of Content and Licensing

By engaging with the Oryum service, you recognize that the platform is rich in various forms of content, including but not limited to graphics, music, sound effects, animations, videos, stylistic elements, and texts (collectively, "Content"). This Content may originate from independent providers under specific licensing agreements, recognized within this Agreement as "Content Providers."

Rights and Restrictions

Numeric Vision Technologies FZCO asserts ownership, licensing rights, or holds legal entitlement over all content displayed on or accessible through the Oryum services. As a user, you acknowledge that you possess no ownership, right, or claim to any of the content, including virtual in-game assets or any account attributes, nor to the Oryum Materials encompassing images, graphics, texts, trademarks, copyrights, and all intellectual property therein. Your access to and use of such materials are solely authorized for engaging with the Oryum service, under the condition that no Oryum Materials will be used, copied, or distributed without explicit written consent from Numeric Vision Technologies FZCO.

Content Liability and User Responsibility

It is crucial to understand that Numeric Vision Technologies FZCO is not obligated to remove content but holds the right to do so at its discretion, particularly if content is used in violation of this Agreement. Users assume all risks associated with content exposure, with Oryum reserving the right to alter, remove, or otherwise manage content as seen fit, without assuming responsibility for content removal failures.

Virtual Assets and Proprietary Rights

All aspects of the service, including characters, items, currency, and in-game assets ("Virtual Assets"), developed through gameplay, are proprietary to Numeric Vision Technologies FZCO. These assets, along with the software and service, are protected by various rights, including trademarks and copyrights, owned by Numeric Vision Technologies FZCO or its Content Providers. These rights are upheld across all forms of content and media, both current and future. By contributing Content to the service, you grant Oryum a perpetual, irrevocable, non-exclusive right to utilize, adapt, and incorporate such Content in any form or media.

Changes to Virtual Assets and Game Features

Numeric Vision Technologies FZCO reserves the right to modify Virtual Assets, game features, and functionalities to enhance gameplay, balance, and user experience. These changes may affect the perceived value or functionality of Virtual Assets, acknowledging that the company continuously evolves its products for improved user engagement.

User Claims and Promises

You agree not to pursue any claims against Oryum, its licensors, or employees related to Virtual Assets ownership, value, or the outcome of any game modifications made by Numeric Vision Technologies FZCO. This includes claims based on account deletion, service malfunctions, or changes affecting Virtual Asset value due to gameplay adjustments. Your engagement with Oryum is governed by acceptance of these terms, ensuring a fair and dynamic gaming environment for all users.

8. Cash Loading and Transactions in the Oryum Shop

Introduction to Cash Loading

The Oryum Shop is a virtual marketplace designed for users to acquire various shop-items that enhance the gaming experience. To facilitate purchases, users must first deposit funds into their membership account through the "Cash Loading" feature, located within the Oryum Shop section. This process involves the use of designated online payment systems to add "real money" to your account, enabling the purchase of items.

Transaction Process

Upon a successful Cash Loading transaction, the credited amount will be immediately available in your account for use. All items available in the Oryum Shop can then be purchased using the credits in your "Account." It’s important for users to understand and accept that once shop-items are purchased, these transactions are final and non-refundable.

Non-Delivery and Mistaken Transactions

In instances where a transaction does not successfully result in the credited shop-items, or if a purchase is made in error, Oryum encourages users to seek prompt assistance. For any issues related to non-delivery or accidental purchases, it is imperative to contact our Support team. Users must submit their claims for non-delivery or report mistaken transactions within three days from the date of the attempted purchase. This can be done by raising a ticket in the support section or by sending a detailed email to [email protected].

Support and Resolution

Our Support department is committed to assisting users with any transaction-related inquiries or issues. We aim to ensure a smooth and satisfying experience within the Oryum Shop, offering guidance and solutions for transaction failures or errors. Our team is dedicated to upholding the integrity of transactions within the Oryum ecosystem, striving to resolve any issues in a timely and efficient manner.

9. Policy on Submissions and User IDs

Definition of Submissions

The term "Submissions" encompasses a wide range of user-generated content, including comments, feedback, suggestions, clan/guild images, icons, emblems, photographs, forum posts, chat room dialogues, emails, and any other materials or communications submitted to Oryum concerning its games or services. By participating in such submissions, you acknowledge and agree that:
Public Nature of Submissions: User IDs and Submissions are considered non-confidential and will become public information upon disclosure, accessible or known to other users and the broader public.

Recommendation Against Personal Information Disclosure: Due to the public nature of Submissions, Numeric Vision Technologies FZCO advises against the publication of personal information (yours or others') through these channels to safeguard privacy and security.

Intellectual Property Assignment

Rights Transfer: You agree to irrevocably assign to Oryum, free of charge, all worldwide rights, titles, and interests in copyrights and other intellectual property rights associated with your User IDs and Submissions. This assignment encompasses the perpetual global use, modification, reproduction, and distribution of these materials by Oryum without any further consent, notice, and/or compensation to you or any third party.

User Responsibility and Representation

Content Ownership and Responsibility: You bear sole responsibility for the content of your Submissions and the management of your User ID. This responsibility includes ensuring the legality, reliability, appropriateness, originality, and compliance with copyright laws of your Submissions. Oryum adopts a hands-off policy regarding the prescreening or monitoring of Submissions, emphasizing user accountability for their content.

No Confidential Relationship

Public Communication: Any communication to Oryum, whether oral, written, or electronic, including feedback, questions, comments, or suggestions, will not establish a confidential relationship between you and Oryum. Except where expressly agreed by Numeric Vision Technologies FZCO, such communications are deemed non-confidential. Oryum reserves the right to use this information freely, including for research, development, and commercial purposes, consistent with its Privacy Policy.

User Communication Responsibility: You are fully responsible for the content of your communications, including their accuracy, truthfulness, and non-violation of others' proprietary or privacy rights.

10. Guidelines for Using Payment Gateways

Offering Quality Gaming Experiences

Numeric Vision Technologies FZCO is committed to delivering high-quality gaming experiences through the Oryum platform, ensuring that many of our services and games can be enjoyed entirely free of charge. While the purchase of in-game items is not a necessity for full enjoyment, users have the option to enhance their gaming experience by acquiring virtual currency and charged items through our integrated online payment system.

Independent Payment Gateway Terms

Review of Terms: Before engaging with any payment gateway offered within Oryum, we strongly advise users to thoroughly review the Terms of Service of the respective payment system. It is essential that you understand and agree to these terms, as they are separate and distinct from the Terms of Service governing Oryum.

Authorization and Representation: By providing payment information through Oryum, you affirm that you are the legitimate holder and authorized user of the payment account being utilized. This assurance is critical to the integrity of transactions within the Oryum ecosystem.

Affiliation and Transaction Integrity

Non-affiliation with Payment Systems: Please note that Oryum operates independently of the embedded online payment systems. Our collaboration with these payment services is focused on facilitating secure and convenient transactions for our users.

Consequences of Payment Reversals: In instances where a payment is reversed, cancelled, or subjected to a chargeback, we reserve the right to suspend your Oryum Account immediately and without prior notice. Further action, including account termination, may be taken in cases of suspected fraud to protect the integrity of the Oryum platform and its users.

Ensuring Secure Transactions

It is our priority to provide a secure and trustworthy environment for all transactions within Oryum. We encourage users to exercise diligence and caution when making payments and to report any discrepancies or concerns to our support team promptly.
